Terms of Use

These Terms of Use (the "Terms") govern your access to and use of the Suivant platform (the "Service"), operated by Suivant ("we", "our" or "us"). By accessing or using the Service, you agree to be bound by these Terms. If you do not accept these Terms, please do not use the Service.
1. Definitions
"Owner" means any person who creates an account to manage one or more queues. "Employee" means a user authorized by an Owner to operate a queue. "Customer" means any person who joins a queue through the Service. "Subscription" means the paid monthly plan providing access to the Service's features.
2. Eligibility
You must be at least 14 years old to use the Service. By using the Service, you represent and warrant that you meet this requirement.
3. Account and Security
Owners must provide a valid email address and a secure password. Employees access the Service through a username and PIN provided by their Owner. You are responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account.
4. Subscription and Payment
The Service is offered through a monthly subscription at the rate indicated at the time of sign-up. Payment is processed by a third-party provider (Stripe). The subscription renews automatically each month. You may cancel at any time from your dashboard; cancellation takes effect at the end of the current billing period. No refunds are issued for the current period.
5. Beta Period
During the beta period, the Service is offered free of charge. No payment is required. At the end of the beta, an active subscription will be required to continue using the Service. You will be notified by email before any pricing changes. No charges will be applied without your explicit consent.
6. Acceptable Use
You agree not to: • use the Service for any illegal or fraudulent purpose; • disrupt the operation of the Service or attempt unauthorized access; • collect other users' data without their consent; • transmit malicious, offensive, or rights-infringing content.
7. Owner's Customer Data
When an Owner uses the Service to manage a queue, the Owner acts as the controller of the personal information collected from its Customers (notably their first name and, where applicable, their phone number). Suivant acts as a processor in this regard. The Owner agrees to comply with applicable laws (notably Law 25 and PIPEDA), to use this information only for queue management purposes, and not to use it for secondary commercial purposes (sending promotions, reselling, etc.) without the Customers' explicit consent.
8. Intellectual Property
The Service, including its source code, interface, and content, is the exclusive property of Suivant. No intellectual property rights are transferred to you through the use of the Service.
9. Service Availability
We strive to keep the Service available at all times, but do not guarantee any level of availability. The Service may be interrupted for maintenance, updates, or any other reason without notice.
10. Limitation of Liability
The Service is provided "as is". To the fullest extent permitted by law, Suivant shall not be liable for any direct, indirect, incidental, or consequential damages arising from the use or inability to use the Service. This includes, without limitation, loss of revenue, data, or business opportunities.
11. Termination
We may suspend or terminate your access to the Service at any time, with or without cause and with or without notice, particularly in the event of a breach of these Terms. You may terminate your account at any time by cancelling your subscription and ceasing to use the Service.
12. Changes to Terms
We reserve the right to modify these Terms at any time. Changes take effect upon publication on this page. Your continued use of the Service after publication constitutes your acceptance of the modified Terms.
13. Governing Law
These Terms are governed by the laws applicable in Quebec, Canada. Any dispute arising from these Terms shall be submitted to the competent courts of Quebec.
